Games Workshop defeated on use of Space Marine Trademark

Spots the Space Marine has been re-listed for Sale on Amazon. Early this week games workshop issues a demand that Amazon take down the book as it was an infringement of one of there trademarks. Completely ignoring the fact the word Space Marine is very much in the public domain, and there existing trademark only covers games , not books. Amazon complied with their demand, but later reinstated the book after EFF and a number of other parties got involved. Pointing out there was no way this claim could stand up in courts as the term Space Marine dates back to the 1930s, long before GW existed. Is this because the G.W. Legal department not understanding the law or are over extending their right to defend their board games and trademark? No one but GW can really say. GW appears to stand by their complaint.

“Games Workshop owns and protects many valuable trademarks in a number of territories and classes across the world. For example, ‘Warhammer’ and ‘Space Marine’ are registered trademarks in a number of classes and territories. In some other territories and classes they are unregistered trademarks protected by commercial use. Whenever we are informed of, or otherwise discover, a commercially available product whose title is or uses a Games Workshop trademark without our consent, we have no choice but to take reasonable action.  We would be failing in our duty to our shareholders if we did not protect our property.

To be clear, Games Workshop has never claimed to own words or phrases such as ‘warhammer’ or  ‘space marine’ as regards their general use in everyday life, for example within a body of prose. By illustration, although Games Workshop clearly owns many registered trademarks for the Warhammer brand, we do not claim to own the word ‘warhammer’ in common use as a hand weapon.

Trademarks as opposed to use of a word in prose or everyday language are two very different things. Games Workshop is always vigilant in protecting the former, but never makes any claim to owning the latter.”

White Dwarf February Pre-Review

This isn’t much of a review, I don’t have the white dwarf in front of me so don’t get too excited. I had a quick look though it last night, as in newsagents not a book store or workshop my time free browsing was limited!

As you must know ChapterMasters is just about 40k, so no amount of outstandingly well sculpted Warriors of Chaos is going to get the ChapterMaster’s stamp of approval. That said this issues is one of the more balanced in recent months. Continuing reading on the Chaptermasters blog here

2012 Games Day – Forge World: The Battle of Isstvan III Horus Heresy display – Part2

January’s White Dwarf promised some pictures of the Forge World Battle of Isstvan  display in February’s issue.

Here are some more close up pictures of the amazing Battle of Isstvan III Horus Heresy display board, at Warhammer World. Including a mass of MkII, MkIII, MKIV power armoured space marines and heresy style jet bikes.

2012 Games Day – Forge World: The Battle of Isstvan III Horus Heresy display

January’s White Dwarf promised some pictures of the Forge World Battle of Isstvan  display in the February’s 2013 issue.  This board is currently on display at Warhammer World. Although it was through glass, I was glad to be able to take some pictures of it without being jostled by the hoards trying to get a good look at Games Day.

I’m sure the White Dwarf pictures will be of much better quality and have some more interesting angles on this epic board.
